Abstract


This article from the system design level analysis, and explore the establishment of project quality liability insurance system faces fundamental legal issues. Meanwhile, the system 's basic situation at home and abroad , China has established the necessity of the insurance system and the difficulties faced also made ??a more detailed analysis . The second part analyzes the implementation of the insurance forms and basic questions about insurance liability . According to the actual situation in various projects and our engineering and construction market realities and combined use of specific types of insurance forms the fundamental basis for the implementation , analysis of the quality of the project to be used by liability insurance embodiment . Meanwhile, the combination of the insurer 's own characteristics and responsibilities of project quality legislation , discussed a range of insurance and insurance responsibility to determine the principles and methods . The third part is about the right to participate in the insurer and insurance subrogation issue. Insurers participate and subrogation liability insurance system for engineering quality is a very important element, whether related to this system can really be established and promoted. This section focuses on analysis and discussion of the insured person the right to participate and the specific content of subrogation to exercise the principles and safeguards. The fourth part is about the quality of the project liability insurance contract issue. Determines the specificity of construction engineering quality liability insurance contract in many ways different from the ordinary insurance contract .
