Abstract


At present , China 's agriculture , rural areas and farmers has become one of the hot issues of concern in the political, academic . Since the late eighties of the last century agricultural economic landslide , scholars have begun to explore the road of sustainable development of Chinese agriculture , land system of household contract responsibility system as the main problem has been a great deal of concern , this paper on agricultural the study of the transfer of land use right of the land system , trying to find a way out for the \This paper , the analysis of the status quo of China 's agricultural land use right transfer from the trajectory of institutional change course and agricultural land use rights of the evolution of the various policies and regulations of the rural land . We found that the transfer of land use rights to some extent solve the abandoned agricultural land , improve land utilization and efficiency of agricultural production , is the inevitable trend of economic development . Many places are advancing the transfer of land use rights in the work of some actively explore the land to large farming and agricultural enterprises concentrated to meet the land needs of moderate scale operation . However, a considerable part of the region is still in a spontaneous circulation or disordered state , the land contract and management rights and interests of the farmers continued to have been infringed , and how to make the transfer of land use rights toward a healthy , orderly development , and the urgent need to address the problem . This paper argues that the farmers ' land property rights fuzzy and circulation insufficient incentives restricted agricultural land use rights transfer , the transfer of agricultural land use rights that kind of market behavior , we must follow the laws of the market , to ensure the dominant position of farmers as land transfer , giving farmers land contract Right of the nature , the freedom of circulation of land to farmers ; organizations and local government , township should give full play to the functions of the public service , to promote the establishment and improvement of the land use right transfer market .
