Abstract


Also undergone important changes in the shipping market and the rapid development of shipping technology , the mode of operation of the ship . Shipping practice are becoming increasingly complex , ship operators , ship operators identify the issue has become one of the urgent need to address the important issue of maritime judicial practice . Although the concept of ship operators have long appeared in international conventions, national maritime legislation and our laws and regulations , but its specific meaning has different opinions. At the same time , the legal relationship involving the ship operators complex , including all aspects of maritime limitation of liability , maritime liens , oil pollution at sea , and maritime security . Ship operators to identify not only affect its own legal status , is also a major party for ship operators relative . This paper uses historical analysis , specification and comparative analysis methods for recognition and legal status of the ship operators superficial research . This paper is divided into six parts , the first part of a brief description of the purpose and significance of the topic ; second part starting from a historical perspective to study the history and development of ship operators ; third part by drawing on the civil law \several models to explore the relationship of the \complexity , the fourth part of this paper analyzes the main common practice to explore how to identify the ship operators in practice ; fifth section analyzes the legal status of the ship operators in the types of legal relations ; 's the last part of this article was conclusions put forward a legislative proposal on ship operators identify .
