Abstract


Environmental factors as a typical public goods, the quality of maintenance in addition to government a positive, proactive and effective management, but also requires the joint participation of the whole society. Public participation in environmental protection, is an important way to solve our environmental problems; important part of building a harmonious society; huge impetus to promote environmental protection. The breadth and depth of public participation in large part determine the level of environmental protection. In the case of China's economic construction and high-speed development, environmental protection complex, the urgency and necessity of public participation is more prominent. In contrast, in the Western developed countries, public participation plays an extremely important role in the cause of environmental protection, the relevant legislation is also relatively well, public participation rights and participation in the program has a clear law. In China, due to the long-term government-led environmental protection, as well as the absence of policies and regulations, in fact suppressed the opportunity for public participation, leading to a low degree of public participation, and the ability of public participation, the effect is not good. Start the practice of public participation in China's environmental protection and the legislative status quo in this article, the elaborate public participation in China's environmental protection several issues: public awareness of environmental concerns high, but participation is not strong; low level of public participation in a single way limited role; social groups, especially the number of non-governmental environmental protection organization, scale, capital, the impact is still very limited. Simultaneous analysis of the deep-seated causes of the lack of public participation: the uneven economic development; long-term government-led environmental protection; Public Environmental Awareness in the absence of errors and the policies and regulations. Then put forward to learn from foreign public participation in environmental legislation and practice, with reference to the study of the theory, and to promote public participation in environmental protection in China: First, to improve the ability of the public to participate in environmental protection, strengthen environmental education and promotion. The second is to increase the public the opportunity to participate in environmental protection, through four main areas: the transformation of government concept promote the institutionalization construction of public participation in environmental protection; disclosure of environmental information, to protect the citizen's right to know; expand the channels of public participation, encourage public The multi-level participation in environmental protection; promote the construction of environmental public interest litigation.
