Abstract


Freedom of expression is one of the basic citizenship protected by the Constitution, and also one of the fundamental values persuaded by modern democratic society. Both for individual citizens and the development of constitutionalism, it is all a extremely important value. Since human society entered the twentieth century, computer technology has advanced and the development of internet in China has entered a large-scale popularization stage. The computer technology developed so highly, that freedom of expression plays an unprecedented part.This paper is divided into four sections.The first part introduced some basic questions of network expression. Firstly, we introduced the importance of freedom of expression, as well as the protection of freedom of expression in world. Secondly, it introduced the emergency and development of the Internet and its features.The second part focused on the impaction of internet on the freedom of expression. The positive impact, from building a democratic constitutional state, disseminating knowledge, promoting exchange of cultures and maintaining of social stability, we discussed on the important values of internet expression. The negative impact, we discussed that freedom of internet expression would damage other interests.The third part discussed the domestic and international regulating station of the internet expression. From the legislative, administrative regulation, industry self-regulation, technical measures and self-discipline areas, we introduced the protective status of freedom of internet expression. We pointed out the problems now existing.The fourth part purposed to improve the protection of freedom of internet expression. First of all, in theory, we should strengthen the research, in order to provide theoretical support. Secondly, we should perfect the legal system for freedom of internet expression. Third, Government should strengthen the protection to internet expression. Fourth, we promoted its self-regulation to give maximum space for their development. Finally, it is necessary to set up the review mechanism of violation of the constitution and to improve the administrative litigation system. And, we should give the necessary restrictions on the internet expression to achieve the protecting purposes.
