Abstract


The expert’s conclusion of identity recognizance is one of a kind of legal evidence. As it is known, we known every evidence must be revive and contested before it is as a ground of an action. Furthermore, with the increasing of democracy, publicity and justice in the suit, the protect of the parts’ procedure rights, as well as direct and oral requites of the court’s trial, so a demand of review the expert’s conclusion of identity recognizance becomes strict, the appeal of the experts is a demand of the time ,as a result ,the experts must contest the conclusion of identity recognizance to the judges and the parts.This paper details the questions of the standard of the expert’s conclusion of identity recognizance, it’s end intends to thought about that can we stipulate a stands and how can we stipulate one. Only through this, a objected stand of the expert’s conclusion of identity recognizance can be made.This paper contains four parts, and has thirty thousands words in all.The first part introduces the difference bout the truth and the attest of the truth of the expert’s conclusion of identity recognizance. At first, it aims at what the true; then we how to discriminate the two. In the end, I set out the meaning of the difference between the two.The second sections of the paper focus on the technical standard of the establishing identity conclusion. In determining practice, if surveyor’s understanding of two should be for being real, must offer certain identification , make it reach set standard.
