Abstract


The challenge and mission which the world is facing is to ensure the sustainable development of the economic world with the sustainability of the fresh water resources. As the largest freshwater lake in our country, the sustainable development of Poyang Lake has significant effect on the regional development even the development of the whole Yangtze valley. With the enforcement of the ecological planning of Poyang Lake region, Poyang Lake is getting increasing attention from all social sectors, which creates a favorable environment for the study of the Poyang Lake development. The realization of the Poyang Lake’s sustainable development is to ensure the citizens in this region the equal living rights and the environmental development rights, and it is also the foundational base to the social development. Only if we coordinate the sustainable development of water resources with the protection of civil rights and regional development as well as the social development, we can emphasize its significance under the construction of harmonious society.In this thesis, four aspects will be covered. Firstly, based on the fundamental theories of sustainable development of water resources, here the research is involved in the theory of Law and theory of Economics to lay a theoretical foundation of studying the legal issues and systems of the water resources in the Poyang Lake area. In the view of the theory of Law, discussion follows on environment right and environmental development right, sustainable development, benefits and beneficial mechanism; in the eyes of the theory of Economics, analysis carry on external theory, eco-economic theory and resource development theory. Secondly, in the process of specifically investigating the legal systems of water resources in America, Japan, the Great Lakes and Rhine River Basin, conclusion is embodied in achievements of standardizing systems and stipulating measures suitable for Poyang Lake area. Thirdly, by researching of the current situation and the results of the water resources in that area, we will find the problems and discover the reasons in the development which mainly center on legal consciousness and legal system guarantee of the water resource. On the basis of analysis above, we will also explore the mode of sustainable development in the region, through four levels, namely, water culture construction, water market construction, water tourism construction and water ecology construction to promote sustainable development in Poyang Lake region. Finally, the writer take a comprehensive study on policy control level, the technical supervision level, the organization operating level, economic level and cultural cultivation level, then put forward the specific sustainable countermeasures for development of water resources in the Poyang Lake region.The study on this subject aims to offer some reference for the coming legislation and macro decision-making on sustainable development of Poyang Lake. It also supplies some new angles of views for the construction of the harmonious development between the human beings and the nature. Besides, it helps to make a little contribution to development of hometown.
