Abstract


Plant variety rights is a unique intellectual property in the field of agriculture, an important part of agricultural intellectual property. Its purpose is to protect the rights of the breeders, to mobilize the enthusiasm of its research and development, and promote the research and innovation of breeding, breeding technology innovation investment diversification. China is a big agricultural and breeding country, strengthen the protection of plant variety rights, has an important role in encouraging breeders innovation, promote the development of China's seed industry, and enhance the international competitiveness of agriculture. Our new plant variety protection system has many deficiencies, intellectual property management foundation work is weak, weak awareness of intellectual property protection, lead to the variety rights Loss abuses have occurred, seriously affect the interests of the variety rights holder. Therefore, the study of plant variety rights protection is of great significance. Start from the basic theory of Plant Variety Protection, the study was to investigate the theory of property rights and intellectual property rights, plant variety rights connotation, the variety power structure and attributes. On this basis, the analysis of the international protection of plant variety rights and learn from the experience of the Plant Variety Protection in China. And analysis of the performance achieved by the Plant Variety Protection system changes and the implementation of the variety rights protection system for the conservation status of plant variety rights in China and the problems, the proposed strategy to promote the protection of plant variety rights in order to improve our Plant Variety Protection System and system enhancements variety rights protection efforts, and promote the variety rights effective operation and application, and to accelerate the implementation of agricultural intellectual property strategies. The text of which is the issue of the Plant Variety Protection mainly from the following aspects: (1) Plant Variety Protection theory. Theory of property rights and intellectual property rights, plant variety rights, plant variety rights connotation, plant variety rights, power structure and attributes of the study was to investigate, analyze the importance and necessity of the Plant Variety Protection. (2) the international protection of plant variety rights and the reference to China. UPOV Convention and the United States, Japan, European countries, the Plant Variety Protection system analysis, overview inductive plant variety rights international protection on the reference to China, to provide a reference for the protection of plant variety rights in China. (3) of the Plant Variety Protection status quo. An Analysis of the Plant Variety Protection system changes with running performance based on empirical analysis of the current situation of the Plant Variety Protection in China combined with realistic data reveals the problems of the Plant Variety Protection in China to have a conservation status of plant variety rights in China clear understanding. (4) Plant Variety Protection Strategy. Innovation strategy from the plant variety rights, the four aspects of the Plant Variety Protection legal protection policies, management strategies, and technology strategy analysis and discussion of the Plant Variety Protection strategy to improve our new plant variety protection system, incentive rapid innovation in plant variety rights to promote the effective implementation of applications for plant variety rights, increase scientific protection of plant variety rights, enhance the scientific management of plant variety rights.
