Abstract


In this paper, \This paper is divided into three parts, the first of the \kind of provision is not only the purpose of criminal law , and in judicial practice operability , will not bring difficulties in understanding and confusion ; secondly, that \generate understanding of ambiguity , and convenient for taking bribes identified ; thirdly, that \Secondly , the author of China's criminal law provisions relating to bribery for analysis , and the \provisions subject scope is not clear . This is not clearly defined bring understanding of the process of judicial determination of disputes and confusion , is not conducive to the fight against bribery , undermines judicial authority ; secondly, bribery provisions is not necessary \.
