Abstract


Xunzi is a very important thinker in the culture of Pre-Qin times, whose thoughts is like a milestone. He studies from Confucian school of thoughts, but proposes linking the etiquette with the law, and also has great knowledge in various schools of thoughts, and forms a style of his own in Xun Studies. Xun Studies not only involves many aspects such as politics, law, economy, education etc, but also forms a system itself. The thoughts of prospering etiquettes and respecting laws have creativeness and far-reaching influence. Investigating the reasons of its occurrence, we find that its prerequisite conditions are social and historical environments in the late Warring States Period, of course, Xunzi’s natural endowments and his personal experiences are also the other important factors. Just because of the profound social and historical environments, Xunzi’s thoughts of prospering etiquettes and respecting laws have a strict inherent logic. Firstly, he puts forward that the human nature is born evil from a creative perspective, which is the theoretical foundation of the thoughts of etiquette and law. Secondly, he proposes the principle of practice of punishment after virtue. Finally, the inclination of his value is to make a harmonious society in which people who have different social status live in groups. It can be seen that prospering etiquettes and respecting laws are the means and approaches, whereas the social ideals are the destinations. It has important impact on the feudal society, which shows mainly that the form of orthodox and traditional law thoughts of feudalism and the construction of legal system of feudalism are all influenced by it.As a result, it is very important to study the value of Xunzi’s thoughts of prospering etiquettes and respecting laws, and it is more important to inherit his value, and from which, we can get a lot of benefits because we advocate to derive nourishment from traditional legal culture today. In other words, the abundant resources of legal thoughts may return to the original state, create the new fields, and make the past serve the present, which can provide the theoretical references to the construction of ruling by law in our modern society.
