Abstract


Chinese scholars tend to feel that the person is the object of international law is the object pointed to by the rights and obligations of the subjects of international law , international law does not set up for personal rights and obligations of the individual 's rights and obligations by domestic law . Some scholars believe that the current practice of international law , individuals are not the object of international law , but the subjects of international law since World War II, international law has been established for the individual specific rights and obligations of these rights and obligations without going through domestic law can be directly obtained from the international law . This paper insisted \And \position to demonstrate : 1. Rights law directly gives the rights of the individual , the individual is the subject of rights of international law . 2 . Court of Human Rights and other international judicial institutions, given the equal right of appeal of individuals and the state , the individual is the right to appeal body of international law . 3 . International conventions, international war and humanitarian law established for the individual shall not engage in acts of piracy , shall be guilty of war crimes and other obligations of the individual obligations under international law body . 4 . Various types of military tribunals since World War II , the punishment of war criminals , to bear legal responsibility for their crimes , the individual is the main responsibility of international law . The main purpose of this paper according to the World War II legislative practice of international law and trial practice , a superficial discussion of international law status of the individuals , and individuals to become subjects of international law, the cause and significance of some of my views , I hope to be able to serve as a trigger effect.
