Abstract


The essence of copyright law is to balance the interests of the copyright owner and the public , and the rational use of the system is a manifestation of this idea . The rational use of system is the prevailing system of China and the United States copyright law , but copyright practice and theoretical research in one of the most controversial and difficult man to understand the rules . Any work in today 's highly developed IT can be spread through the Internet, digitization , the characteristics of the network makes the works of the copy , download , modify and propagate very easy and low cost network environment of the system from the legislative and judicial practice significant challenges . In our country , the reasonable use of the network copyright system has only just begun , is still in the exploratory stage , even in the rational use of traditional copyright nor the formation of authoritative institutional theory . Many scholars in explaining the system , they are mostly references the point of view of foreign scholars . And the United States due to the application of Internet technology earlier than China , the United States on the network the right to use reasonable use system both from the legislative or academic research ahead of China, the worth of and learn from .
