Abstract


\Advantage of existing resources base, strengthen the scientific and technological innovation and intellectual property protection , market competitiveness of manufacturing a number of products, is the realization of farmers income, agricultural industrial structure adjustment and rural economic development in an important way. However, for the \. This article is the intellectual property system of the \Chinese herbal medicine as a precious resource , Jiyuan rubescens are many advantages of our resources in a typical , its development and utilization of intellectual property protection also has some representatives significance. According to field survey data and relevant theory , the article analyzes the use of Jiyuan rubescens in the process of industrialization of emerging issues, namely rubescens market acceptance of related products and added value is not high. Meanwhile , through the protection of genetic resources rubescens , patent protection, protection of geographical indications , trademarks and other available means of protection analysis, summarized rubescens industrial development in the lack of intellectual property protection , that the legal system is imperfect, the role of government not in place, innovation is not high, the irrational distribution of industry profits , as well as the protection of genetic resources and ineffective . To solve these problems , the article constructs Jiyuan rubescens on intellectual property protection system , namely the protection of genetic resources rubescens as a clue to patent protection as the main body to trademarks and geographical indications system as a support to trade secrets and copyrights protection is added , co-operation with other protective methods , research cooperation and innovation , the integrated use of a variety of protection , the relevant body to obtain a fair and equitable benefits of intellectual property protection system.
