Abstract


Order is the prerequisite and basis of all human activities , and the constitutional order is inevitable logic of the evolution of human political order , the fundamental requirements of a modern society based on the rule of law , there has been some event of state power against citizens' rights in the process of building a socialist harmonious society , the state power issues become increasingly prominent , these issues be handled properly , and cause damage to the civil rights on the one hand , on the other hand , is not conducive to social harmony . How to regulate the state power to protect citizens' rights , improve the constitutional order , the major theoretical and practical issues to build a harmonious society . From the perspective of the state power to reveal the main problems of our constitutional order , and in the cause of the problem on the basis of in-depth analysis to generate , put forward a viable path to perfect our constitutional order . The text is divided into four parts : The first part is a general theory of constitutional order . Clarify the legal order , on the basis of the concept of constitutional order to clarify the relationship between the constitutional order and state power . The second part is the association of a harmonious society and the value of the constitutional order , mainly on the order and harmony with the inner unity , constitutional order is an important guarantee of the harmonious society and a harmonious society is the value of the constitutional order goals . The third part is the analysis of the problems and causes of our constitutional order . Of our constitutional order from the perspective of the state power , there is the operation mechanism is not standardized, incomplete procedures , and the protection of human rights is not in place practical problems , and in-depth analysis of the reasons for problems . The fourth part is to put forward a viable path to perfect our constitutional order . Specifically addressed to establish the authority of the Constitution , to protect the implementation of the constitution ; norms of state power , to achieve effective supervision of state power ; protect citizens' rights and to achieve a rational balance of state power and civil rights aspects of initiatives to improve the constitutional order .
