Abstract

With the rapid development of science and technology , and litigation related to professional issues and science and technology , more and more problems . The judge is just legal experts is not the all-rounder , a loss of the highly specialized nature of the problem . Forensic people as professionals discovered the truth of the facts of the case , as the subject of the scientific evidence , and accurate identification of justice is of decisive significance , is the core of the entire forensic system . Forensic system , there are many defects, is a serious impediment to the development of forensic system and the administration of justice to achieve real reform and improvement of the necessary . This paper tries to deficiencies in the system of our forensic people and lead to confusion status causes reflection , differences , advantages and disadvantages of the relatively common law and civil law systems Two Schools Forensic Expert System , learn from the advanced experience of the two legal systems , and explore how to combine our system of judicial appraiser actual situation and the judicial tradition perfecting the relevant judicial identification of people 's laws and regulations , more scientific establish our judicial identification of people 's status , eligibility elected , rights , obligations and legal responsibilities , and testify in court the basic system , in order to improve our judicial appraisers system . In this paper, China's actual conditions as a starting point , foothold in judicial expertise system 's basic theory , learn from the the Judicial Expertise system research field in the leading position in the country 's judicial identification of people specification developed practice and advanced concept and meticulous combing and think about the Judicial Expertise System in China 's general mechanism , and to review the problems with the legislation and practice of the forensic system , to put forward the improvement and perfection of Forensic legislation and practice basic path and Countermeasures . In order to be able to provide some basis and reference for the Perfection of Forensic safeguard judicial justice and authority make a small contribution to change the chaos of Forensic Expert System .
