Abstract


All power in the People’s Republic of China belongs to the people, the National People’s Congress and the local people’s congresses at various levels are the organs through which the people exercise state power. According to the Constitution and and relevant laws, it is one of the the local people’s congresses at corresponding levels and their standing committees’ duties to supervise the government, which, according to the practices in recent years, including two aspects----legal supervision and work supervision. The supervision of local people’s congress is fundamentally a kind of supervision of power, compared with other ways of supervision, it is with characteristics of authority, overall characteristic, supreme and openness. The effective supervision of the local people’s congress to government reflects the thought of socialist people’s sovereign, which is the demand of the development of socialist democracy, the strenghen of country’s regime construction, the realize of regime restrict, and the warranty of scientific and democratic decision-making.Look back and through the analysis of the development progress of the supervision of Zaozhuang People’s Congress and its standing committee to government, there are many similar aspects between Zaozhuang People’s Congress and other ones:they exercise their power according to law, and have made certain achievements. However, as there are social transformation problems such as the supervision system is not straightened out, traditional views are influencing, the self-construction is not complete, the right to know could not be protected, and <Law of the People’s Republic of China on Supervision by the Standing Committees of the People’s Congresses at All Levels> is not carried out in place, the society doesn’t fully realize the supervision of people’s congress, the content of supervision is not balanced, lack of mandatory and real-time implement, and not sturdy in its course.Through the analisis to the situation of the supervision of local council to government in western countries and combine the practice of local people’s congress in China, what is found out is that there are many aspects which are worth learning, such as the awareness of democracy and legality, council’s self-construction, the complete law system for supervision and the openness of the supervision to government.Based on the analysis of the existing problems and their reasons, the article puts forward methods to improve and strengthen the supervision of local people’s congress to government. Main countermeasures are:improve the cognition to the supervision of local people’s congress by strengthening the legal publicity, improving the awareness of both the people’s congress and government; straighten out the supervision system by handling the relationships between the local people’s congress and party committee superiors, and between the support to the government’s law-based administration and the people; complete the self-supervision system, decision-making supervision system and effect tracing system of people’s congress; build a supervision information communication channel by strengthening open government, promoting the deputy’s activities during the meeting is closed, set up a regular information notification system and smooth the petition channel; improve the self-supervision ability of local people’s congress by improving deputy’s quality, standing committee meeting quality and increase public sectors, etc.
