Abstract


The administrative counterpart participation right is an important administrative counterpart procedural right, It is the natural extension of human rights, and it plays an important legal position in administrative system and administrative management activity. Many countries both in the academic and practice have researched and completed legislation about the administrative counterpart participation right. Although preliminary China has given recognition about the administrative counterpart participation right, theoretical study and practic in which is still exist flaw. By comparison, it makes the importance of protecting the administrative counterpart participation right explicit. Strengthen cultivating the concept of the administrative counterpart participation right, improve the security approach of the administrative counterpart participation right, and finally achieve the target of administration according to law, constructing lawful government.
