Abstract

Problems about insurance contract in blacking period are always the blank in our country’s legislation, which not only affect our country’s insurance practices of operation, but also lead to a series of disputes of insurance practice. Continuous happen of similar cases make the theorists and the practice sessions pay more and more attention to insurance contract in blacking period. Insurance as dispersive risk and the legal system for the compensation of losses, shall protect the interests of policy-holder and insurant conscientiously and effectively. This is the inevitable requirement of the insurance industry’s development and expansion in our country, and also this is the meanings of harmonious society. On the very account, this paper regards insurance contract in the special time“blank period”as the research object. The whole paper is starting from two cases of insurance contract disputes, then summarizes the produce, characteristics, relevant legal questions of insurance contract in blacking period, and then does research on the effectiveness and other relevant legal issues of insurance contract in blacking period, finally propose some legislative and judicial suggestions on the experience abroad to perfect insurance contract in blacking period.
