Abstract


Housing is the essential material condition for the citizen to survive. The right to adequate housing is one of fundamental human rights. The house, which is particular as a commodity, is difficult to guarantee the balance between supply and demand or harmony and justice of distribution only by market. Urban housing problem has been a worldwide puzzle. Although the real estate industry has played a major role in developing the economy in recent years, the housing burden of the low and middle-income group become heavier, which affect the harmony and stability of the society. This is a social and politic problem more than an economic problem. As an important part of housing safety net, the affordable housing system established in 1994 guarantees the low and middle-income group from the housing problem, depending on the government using the market mechanism and macroeconomic regulation. However, in default of related legislations and institutions, many problems appear in practice, such as the supply object, housing standard and price is out of control and so on. So it is urgent to develop and improve the affordable housing system.From the visual angle of economic law, the thesis makes a systemic and comprehensive analysis of the affordable housing system, and puts forward legal countermeasures on the basis of comparative study with public housing systems in other countries or districts. It has the following main aspects:PartⅠThe general situation of the affordable housing system. Firstly, it elaborates its concept and character. Via comparing with the commercial housing and the low-rent housing, it emphasizes on its integrity of safety and commerciality. Secondly, it introduces the history and function of the affordable housing system. Thirdly, by the analysis of its theory, it demonstrates the necessity to develop the affordable housing system.PartⅡThe legislation, practice and learning from the public housing systems in other countries or districts. Taking into consideration national conditions, it concludes illuminations to perfect the affordable housing system, based on a classified and comparative research on their origins and features. PartⅢProblems appeared in the affordable housing system in effect. The affordable housing system makes notable progress in enlarging housing supply, depressing price and perfect housing supply system. It is popular with the low and middle-income group. However, in default of related legislations and institutions, many problems appear in practice, for instance, the supply object and housing standard is out of control, and the fiscal subsidy runs off and so on.PartⅣOn perfecting the affordable housing legal system. On the basis of PartⅡand PartⅢ, it tries to suit the remedy to the case and advances ways to perfect the affordable housing legal system, in order to get out of institutional dilemma.
