Abstract


Proceed from the relationship between the political and civil litigation , to explore the interactions and constraints between the comparison of Chinese and foreign political framework of the civil litigation system construction related degree , from the political and constitutional level , the improvement of the rule of law for our civil litigation provides a new way of thinking . This paper is divided into four parts. First : general civil litigation and political relations . From the legal and political relationship come out of the civil litigation and political relations , politics is the basis for a civil action , civil action would affect the political . Second : the Western Perspective Constitution and civil actions elements of docking . Learn from the advanced experience of the developed countries of the Western rule of law , from civil competence , jurisdiction , the basic appeal of the parties and the National Public Prosecution the right to find related point of political and civil litigation . Third : China's current political life and civil litigation relationship patterns analysis . Attempts from the system design and the actual situation of our analysis of the relationship between our modern political life and civil actions . Fourth: the civil action in the Chinese political context the basic trend . Given a decisive influence on the politics of civil litigation , to consider the impact of the civil action toward some of our important political factors , at the same time analysis to predict the basic trend of China 's Civil Procedure .
