Abstract


Food security is directly related to people's health, economic development, social harmony and stability. The endless stream of food safety incidents, forcing people to have to re-begin to pay attention to food safety issues. February 28, 2009, the seventh meeting of the Eleventh National People's Congress Standing Committee passed the \Memory in a serious problem. Indicating that the full range of a major shift of China's food safety legislative concepts to the regulatory model. Overall it seems, the new law exciting, not only to correct the serious drawbacks of the old law, and also added some new content. Increasingly grim for the current food safety issues, seeking a good way to ensure food safety from the theory of corporate social responsibility, to find out the reason of the presence of China's food safety problems through the analysis of the problems of the field of food safety. For the reason, the theory of corporate social responsibility combined with the existing legislation, the reconstruction of the legal system of China's food safety, solve the problem of the too abstract statements about the terms of the corporate social responsibility in the current legislation, to enrich and improve the system of food safety laws. The first part is to find accurate gist of the theory by introducing the theory of corporate social responsibility,. Clear the basic meaning of corporate social responsibility and its philosophy. The second part is based on the theory of corporate social responsibility, China's food security situation by introducing the case to make an objective analysis to identify food safety problems in China, and the emergence of the problem analysis the reason. Pointed out that the emergence of China's food safety problems are many reasons, one most important reason is that food companies is a serious lack of corporate social responsibility. Found that the concept of corporate social responsibility in our legislative scrutiny of China's food safety legislation, has experienced a process from scratch. Degree of corporate social responsibility philosophy embodied by the new law are still not ideal, is not conducive to the judicial practice, the need for building related systems. The third part is based on the introduction and analysis of some of these, by reference of foreign legislation, proposed the idea of ??the number of system build. First, to enhance food production, and the concept of food security responsibility to run a business; Second, establish and improve long-term food safety management mechanism; once again to strengthen the food safety aspects of the legal system construction. Finally, our analysis of the need to establish industry self-regulatory organization to put forward ideas to build China's food industry self-regulatory organization.
