Abstract


Construction Contract between the developer and the contractor to complete the construction of the construction of the building project , the definition of the rights and obligations of the contract , the main basis of the construction quality control , investment control , schedule control and security control , should as far as possible The content is comprehensive and accurate . Now use \the diversification of the imperfections in the model contract , comprehensive contract exposed , the need for research and improvement . The Construction Contract flawed performance in the following six areas : the scope of the contract model text is too large ; method for determining the contract price is not clear ; payment provisions of the contract price is not comprehensive enough and concrete ; the BOQ inaccurate ; provisions of the performance bond too general and did not play the role of the performance guarantee ; terms of the construction contract is fair enough , excessive emphasis on protection of the interests of the owners . Four countermeasures for the defects of the construction contract , suggested a solution : amend the the perfect construction contract model text ; improve the content of the contract at the time of the conclusion of the contract by the special terms of the construction contract ; perfect the legal system and project management standards ; strengthen the quality of contract management construction.
