With the advent of the information age, the software industry as the core of the information and communication industry and the basis of the national economy information has become a leading industry in the race to develop the strategic focus of international competition and countries. To stimulate technological innovation vitality of the software industry, Germany and China being conditional on the software invention for patent protection. Due to the many features of the software technology innovation, enterprise software patent application behavior and the impact factors than other areas of technology is quite different from the existing research systems analysis yet on this issue. Therefore, the Sino-German enterprise software patent application behavior and its influencing factors as the theme, integrated use of law, economics, management theory on this theme in-depth analysis, based on the theory of the previous studies refined enterprises factors of motivation and impact of software patent applications, to build the model of the theoretical analysis and proposed a series of reasonable assumptions, the research results of empirical research in Germany and China, to verify these assumptions, opinions, and conclusions drawn with a certain theoretical and practical value. First, based on the analysis of the enterprise software patent application for motivation and influencing factors, this paper established enterprise software patent applications decision analysis model, and pointed out that the legal environment, firm size and product type are the key factors of enterprise software patent application behavior. By empirical research data quantitative analysis of various factors that impact on the behavior of enterprise software patent applications, the use of the the interaction analyzes legal environment, and significantly related to firm size and product range and enterprise software patent applications. Followed by in-depth analysis and comparison of the three on software patents in Germany and China-related legislation, judicial precedents and review practice, combined with the empirical analysis of the bilateral enterprise software patent application behavior 1990-2008, draw legal environment is the enterprise software The direct impact of the patent application behavior factors, a stable legal environment more to promote enterprise software patent application behavior occurred. In addition, the firm size, product range and enterprise software patent application behavior significantly related, Germany and China, the legal environment, policy environment, corporate patent awareness are different, but the firm size and product range of enterprise software patent application behavior exhibited very Similar degree of influence. Based on this, we propose the independent impact of firm size and product range is the behavior of enterprise software patent applications, the not legal environment, and other factors. Finally, based on theoretical analysis and empirical research, enterprise software patent application behavior is a strategic choice made by the enterprises own subjective goals and desired impact of the objective conditions of the enterprise software patent applications. We build these two dimensions enterprise software patent strategy selection model, proposed enterprise can be combined according to the legal environment, firm size and product range three key factors affecting the main application motivation be combined to make a strategic choice, and through case studies prove the usefulness of the strategic choice model and the effectiveness of specific strategies, summed up the six kinds of successful software patent strategy.
