Abstract


With the pace of economic globalization, there is a trend of internationalization in the intellectual property protection. The trend has became more obviously after the birth of the WTO and the TRIPS Agreement. The TRIPS Agreement leads pattern of international intellectual property system. Relying on the dominant position in the intellectual property rights, the developed countries pursue the international intellectual property protection all of the world. That brings up a negative impact to the development of developing countries. Because of the low level of technology, the wake awareness of intellectual property and the high standards of intellectual property protection and other factors, the developing countries in a passive position in international intellectual property system. So, the developing countries must seriously study the policy responses to address this situation. Such as improving the intellectual property legislation, strengthening enforcement of intellectual property rights, increasing the investment on R&D, lifting the capability of technology innovation, and actively seeking opportunities for cooperation with other developing countries.This article tries to do some research on the impaction of globalization of intellectual property In the case of three representative developing countries of China, India and Sri Lanka. I use large amounts of data to analyze the gaps among the developed and developing countries and the differences between developing countries on the issue of intellectual property protection. At last I find out the efforts and inadequate of the developing countries when they face the process the globalization of intellectual property and give some tentative suggestions.
