With the acceleration of the process of the rule of law, the continuous improvement of the subjective consciousness of the people in all areas of equity issues by the widespread concern in society. Systematic legal protection provisions of the equal right to education is not legal, legislative, and equal right to education, legal protection provisions less excessive declaratory legislation and so affect the realization of citizens' equal right to education; equal access to education problems in the protection of the right of administrative law enforcement makes a very unfavorable for equal civil right protection; lack of understanding of the equal right to education, judicial protection so equal right to education, lack of effective relief are violated, further hampered realization of the equality of all citizens the right to education. At present, China's equal right to education in the field of higher education, although mentioned the word \Therefore, gender perspective, based on higher education and a more in-depth discussion of our equal right to education from a juridical point of view and pedagogy angle. The thesis is divided into three parts. The first part introduces the theory of gender and equality in the right to education. First introduced gender theory, including the the gender connotation and function of the analytical methods of the gender perspective. The introduction of the equal right to education includes the connotation and characteristics of the definition equal right to education, and higher education equal right to education. The theory of gender and equal right to education is the foundation and prerequisite of the subsequent factors analysis and strategy thinking. In the second part by reference data and tables, respectively, from the inequality of educational opportunity, the process of education inequality and unequal educational outcomes described in three aspects of gender inequality in higher education and its performance, education and the field of higher education in China The right to gender inequality in the analysis of the political, economic, cultural and institutional factors.
