Abstract


Since the advent of surrogacy, its practice and academia has always been controversial. In particular, the law explicitly prohibited in our medical institutions and medical personnel to implement surrogate technology, but Surrogacy has its own rationality. Therefore, this paper analyzes the rationality of Surrogacy, surrogate mother and then the process of protecting the legitimate rights and interests of relevant parties.This article is divided into six parts. The first part is introduction, the relevant background surrogate. The second part is the concept of surrogacy. From a variety of definitions of surrogacy, the concept of surrogate drawn so as to demonstrate the rationality of Surrogacy lay the premise. The third part of the status of national legislation regulations and China, through the legislation of foreign countries on behalf of the pregnancy, and China’s Hong Kong, Taiwan and the mainland legislative situation, looking for recognition in our Surrogacy laws support. The fourth is a part, in which, the rationality of Surrogacy, from reproductive rights, health rights and the principle of public order and good morals of the three aspects of the rationality of Surrogacy. Part V Surrogacy problems and remedies. Surrogacy conditions from the requirements of surrogate motherhood and surrogacy surrogate babies and children’s right to know the three aspects of Surrogacy in solving problems, and advocate the establishment in our country, "Surrogacy Law”. Part VI is Conclusion. The conclusion is to recognize the legitimacy of Surrogacy, and the related proposed legislation to protect the rights of relevant parties.
