Abstract


With the development of tourist industry of our country, the civilized histories of several thousand years of Chinese nation, have pregnant with a large number of historical relic tourist resources with national characters in our country,what’s more, there is a lot of the ethnic minorities’traditional cultural resources in the minority district as well. As we all known, tourism resource is one of the most important lifeline of tourism industry. How to protect tourism resource has become a long-term work and mission. With the continuous development of ethnic cultural resources tourism economy, especially in the short-driven, all tour operators quick success of blind development and construction activities would not only lead to destruction and degradation of tourism resources, but also lead to imbalance of ecological systems and the distortion or even extinction of the ethnic minorities’traditional cultural.However, as of now,we haven’t enacted any special laws or administrative regulations, the rules of the ethnic minorities’traditional cultural resources are just found sporadically in some lower-ranked regulations. This situation makes the ethnic minorities’traditional cultural resources development and utilization have become a focus of all society.In view of the current situation of ethnic minorities’traditional cultural resources legal protection at present in our country, this text make an all-round way analyze and study for the legal protection in development and utilization of the ethnic minorities’ traditional cultural resources which under the market economy, and the purpose is to improve the system of the historical relic tourist resources legal protection of our country, and to strengthen the protection of the ethnic minorities’ traditional cultural resources, realize the sustainable development of ethnic minorities’ traditional cultural resources and tourism industry.The article is made up of four parts in the structure. The first part make dalias an example, analyzing some about fundamental theory of the ethnic minorities’ traditional cultural resources. And through analyzing the concept and characteristic of the ethnic minorities’ traditional cultural resources, to interpret the necessity of the legal protection.The second part, mainly analyzing the problems facing in protecting of the ethnic minorities’ traditional cultural resources, introducing the current legislation of the ethnic minorities’ traditional cultural resources, followed by analysis the legal protection legislation and law enforcement problems in dali.The third part introduces the legal protection of the international of minority traditional culture tourism resources. Then through learning the successful experience of Japan, South Korea and the United States, and its inspiration to our country. Part four is the completion of the legal protection system of the ethnic minorities’traditional cultural resources in our country. Including the principles of traditional ethnic culture tourism resources legal protection, establishing community participation in ethnic minority areas, and sharing the benefits of the ethnic minorities’traditional cultural resources development. Furthermore, we need to raise the overall quality of law enforcement officers and improve their ability to enforce the law. Establishing a tourism resource development and protection system of legislation, national and local, that it can provide beneficial legal safeguard for the protection and development of ethnic minorities’ traditional cultural resources in China, in order to realize the sustainable development of tourism resources.
