Abstract


With some savings with the social and economic development in China, people eager to find the operation of the road can create wealth, business franchise provides a fast channel. Successful business model as a modern Western commercial franchising its high-speed, low-cost, on a large scale expansion shows strong vitality. Bring the franchise concepts from first KFC settled in Beijing in 1987, the Commercial Franchise quickly rooted in China, there are a large number of franchise companies in many industries. Business franchising has become an important operating system for the development of commodity economy in China, but the development status of China's current franchise market there are many problems, mainly reflected in the following aspects: Chartered immaturity of the market participants, Chartered market players unequal nature of the relationship between the franchisor fraud is serious, which is one of the main reasons is our franchise legal and regulatory environment is not yet complete. In order to better regulate commercial franchise market franchise in our country more prosperous and orderly development, at this stage, I believe that is necessary to learn from foreign commercial franchising activities regulated by the laws of the beneficial practices and mature experience, through introduction of a new regulatory system and modifications were not suited to the Chartered Institute of Marketing Development Status regulatory means to create a new situation of China Franchise Business legal environment to ensure effective regulation of franchising authorities of the Chartered Institute of Marketing, reduce legal franchise market risks, protect the potential to be the legitimate interests of the franchisor. Start from the definition of franchise Franchise Business legal characteristics reveal the substance of the franchise relationship legal status inequality, and lack of self-regulation from the franchising market to protect consumers as well as the franchisee's point of view explained the need to improve the legal regulation of franchising, a comparative study of foreign mature franchise regulatory system, analysis of franchise information disclosure system and filing system needs to be improved, and on this basis, this paper proposes the establishment of franchise in China \Through the improvement of the existing information disclosure and filing system, and the introduction of a third-party professional intermediaries, the franchise industry standards supporting systems so as to improve the legal and regulatory environment to create a good all-round commercial franchising franchise and the subsequent regulatory, escort for the further development of China's franchising market.
