Abstract

Coal enterprises as high energy consumption, high pollution, high-risk energy companies for social responsibility has its own particularity, relatively heavier than other enterprises. Principled and fuzzy because of the provisions of the Company Law, the Legal System of our corporate social responsibility very problem, using legal means to procure coal enterprises to fulfill their social responsibilities more difficult. Therefore, it is necessary to establish the appropriate legal safeguards and oversight mechanisms to so coal Corporate Social Responsibility implement. Better able to fulfill their social responsibilities, one hand to accelerate the state-owned coal enterprises to operate social, nurturing a competitive market players; the other hand, we should actively urge to fulfill the social responsibility of corporate misconduct commitment should fulfill in order to make the coal enterprises responsibility. The study of corporate social responsibility theory, applied to coal enterprises, urging its pursuit of economic interests at the same time, continue to raise awareness of social responsibility, seize the development opportunities, and better for the benefit of social significance. In this paper, based on the theory of corporate social responsibility in the extensive collection of data to focus research on the basis of the first analysis of the current coal enterprises to fulfill their social responsibility exist problems and reasons for coal enterprises to fulfill their social responsibility legitimacy, specificity and necessity elaborated, clear transformation of economic development and social responsibility concept is closely related to the realization of the long-term profit goal of coal enterprises, rely on the concept of corporate social responsibility. Then investigate the government, the coal companies and the respective responsibilities of stakeholders, government guidance, enterprise's own awareness of stakeholders to actively protect their rights and to procure coal enterprises to actively fulfill their social responsibilities. Finally elaborate make the coal corporate social responsibility to fulfill in place, and how to establish the appropriate legal safeguards and oversight mechanisms. Measures to establish legal protection mechanisms: clear legislative purpose and principles of law, the establishment of corporate social responsibility system suitable for China's national conditions; introduction of the Corporate Social Responsibility Law \operability, easy to stakeholders to the judicial proceedings;; establishment of public interest litigation legal system to protect the interests of stakeholders in the form of contracts. Outside the legal protection mechanism and policy and ethical aspects. Stressed the legal level, the government level, social organizations and stakeholders coal enterprises to fulfill their social responsibility oversight mechanisms. Macroeconomic theory of corporate social responsibility and the microstructure of the coal enterprises in China's reality, it is not only the value of this study and of the original, but also China's coal enterprises to implement the the harmonious development strategies, the inevitable choice of the road of sustainable development.
