Abstract


Employment crime is a broad representation of the employment relationship as the basis for criminal activities as a criminal phenomenon, is the employer party to provide certain property interests or other specific interests for the price conditions implemented separately by the other party or employers to implement crime criminal phenomenon. In today's social transition and vigorously develop the socialist market economy, employment the endless criminal cases, caused great harm to society, causing the concern of the theory and judicial sectors. This paper attempts to analysis of relevant case employment crime differences focus, then the concept of the focus on these differences - Employment crime, the nature of the assessment, make the further definition of the concept and nature of the crime on employment. Criminal liability based on theoretical basis to determine the criminal liability of the different types of employment crime identified through the study of the implementation of criminal responsibility, the author currently employs criminal cases in view of the conviction and sentencing issues, and finally the death penalty applicable recommendations. Identified by the employment of the crime of criminal responsibility, the better to regulate such phenomenon of crime, maintaining social stability and harmony. In addition to the introduction and conclusion, the main text is divided into four parts. The first part introduced by the case merits Profile and judgment, leads to the Employment crime controversy and the focus of this paper is to discuss the problem. The second part describes the current theoretical circles employment concept of crime and the nature of the differences, and these differences make the assessment, the understanding of this paper, the concept of crime and the nature of employment. The third part of major research the employment criminal responsibility for crimes commitments to criminal liability based on the theoretical basis of this analysis.
