The small house property is built on farmers collectively owned land and housing, for sale to non- members of the farmers' collective ownership certificates not issued by the state housing authorities but by the township government or village committee issued . Small property room from the \the total development of the Chinese real estate industry over the past decade has led to many social problems. The small property listings was born in China 's social background and specific legal system , the social , economic and legal systems of various factors combined effect of the results . Small property right system because the premises of one of the ' legislative mode , urban and rural land dual structure within the framework of national land ownership and collective ownership of land legal status inequality , collective construction land use rights can not be a free flow of the land market . Although the government departments to take repressive measures , but the small property room , I believe that does not change the existing system of rural land , these measures are ineffective , are more likely to intensify social contradictions caused livelihood issues . The article used to ask questions , analyze problems , solve the problem of basic methods and steps from the analysis of the current situation of small property , causes start small property housing-related legal issues , the legitimacy of the presence of small property room , rationality as well as to explore the necessity and feasibility of the legalization of small property room , concluded that small property right should be given legal status . We should legalize small house property as an opportunity to change and practice development gap between the current rural land system , improve the system of collective land ownership , build collective construction land use right and residential land use right to a free flow mechanisms , deepen dual land system reform , and ultimately to achieve the integration of urban and rural areas .
