Abstract


Throwing objects buildings cause damage behavior because it is difficult to determine the specific offender , has become a new type of infringement . China 's newly published Tort Liability Act , this problem has been clearly defined . Article 87 of the Law provides : \material compensation , \Which states that does not comply with the basic principles of tort law , and hinder citizens freedom of action and the possibility of infringement of citizens' privacy . Article legislation reflects the good wishes of the legislators an attempt to better relief of victims , is the rising aspirations of the moral law , but has not been widely accepted by citizens . At the same time , the legislation reflects the law of tort in the highlight function somewhat poverty and conceited . Tort law should not take on too much responsibility , nor should it be the only way of the relief of victims . Now, we can be reasonably set up a monitoring device and improve the property management system to prevent the occurrence of such violations , relief can be obtained by accident insurance . In the long run , improve the social security system is a better means of relief .
