Abstract


Property management industry in China has developed more than twenty years, initially made some achievements, but still in its infancy, it continued to mature in the process exposed many different levels of legal issues. Such as property management laws and legal system needs to be improved; owners of legal consciousness; property management operation mechanism of self-government organizations to play a role not ideal; property management business activities are not the norm; property relations is not clear, real estate companies and property companies more as a \relationship; market-oriented property management mechanism is not established; low quality property management team, management of science and technology content is low; property management service charges is difficult; illegal, development and construction unit is serious encroachment maintenance funds; lack of guidance, good development property management Atmosphere has not yet formed; Property Management Association should be strengthened and expanded and other issues. These problems are many reasons, including: property management imperfect legal system, legislative lag; owners of property management awareness is weak, difficult to form a dominant position; government department supervision; Property Management Association can not fully play a coordinating role. Where the legal system is imperfect property management, legislative lag is the main reason. Therefore, the development of a sound legal system of property management, property management industry is to solve the legal problems that exist in the best way. Property management industry in the presence of these problems can be resolved is the property management industry key to healthy development, these problems can directly affect people's living standards, is not conducive to social stability. Therefore, this paper, the property management practices of the outstanding legal issues as a starting point, combined Yanji City residential property management problems in research, trying in our property management on the basis of existing legislation, learn from foreign advanced property management philosophy and systems for the legal system of property management and property management perfect solution to provide some legal issues a feasible method. In addition to legislation other than the perfect property management, strengthen the administrative supervision of the government regulate the property management industry is also an important means. This article from the norm preliminary property management behavior, to solve the \maintenance fund management, accounting for misappropriation of maintenance funds to solve the problems; establish and improve the \, for legislative and regulatory pronged approach, a better solution to the property management industry problems, so that our property management industry to develop healthily. Property management objects include residential, office buildings, commercial buildings, hotels, warehouses and other plants, including most importantly, residential area, and the current problems in society is the most residential area, so the object of this paper is limited to residential property management.
