Abstract


Criminal victims by criminal ACTS as a victim, direct violation is criminal lawsuit to protect the concrete object, also is one of the reasons of criminal procedure. Therefore, how to protect the victim’s rights, becomes the criminal procedural law will focus on one of the problems with good.China’s criminal procedure law, the victim is involved, however, the legislation of our country in the victim’s rights protection and scope of the setting is very vague and half-baked, this is one for the party with the position of the defendant criminal litigation rights and contrast, when the very. Look now, many of the world’s countries, especially those in the western developed countries, to protect their rights to the victim has very intact, and our national rights protection measures, although the victim has made great progress, but than once in this issue has done enough. In order to achieve the ultimate goal of justice, socialist country legal spirit and humanistic care, to narrow the distance with the international standard in China, the victim of criminal litigation rights protection has become quite urgent and urgent, so we should strengthen countermeasures to implementation of victims’rights protection. Since the beginning of the victim, in all cases, criminal lawsuit has been around to protect the victim is the lawful rights and interests of the criminal crime with these two aspects, how to guarantee the right of the victim’s criminal procedure law should be emphatically, and the main problems to solve. Therefore, from the victim of historical development status of criminal lawsuit, earnestly analyze it at home and abroad with the development of the situation, we can awake, strengthen the victim’s rights is the dominating form.From this research related background, first detailed expounds the concept and characteristics of criminal victims and criminal victims right protection, and focus on the historical evolution of the criminal procedure law of our country in the analysis of the status and rights protection victim and connect to protect defect analysis shortage, then discusses in the criminal procedure law, the necessity of rights to protect the victim is proposed in the end point of criminal procedural rights protection countermeasure perfecting the victim.
