Abstract


Enterprise is an incorporation, which possesses both human capital and non-human capital, and in which members of the enterprise generate profit under the guidance of certain institution. Modern enterprise theory takes it for granted that enterprise in essence is a contract comprised of human capital and non-human capital. Human capital property rights play a special important role in the mechanism arrangement of enterprise property rights institution. Property rights institution of human capital is the basis of enterprise and fundamentality of developing enterprise in which it plays an extremely important role. Starting from analyzing the views on human capital and human capital property rights, this thesis discusses some main frame of property rights institution of human capital which is a system about forming, defining, transferring, and profiting of the main body of property rights of human capital. Human capital property rights include property ownership and right of use, right of eminent domain, income right, etc. It reflects which is a kind of rule to exercise these rights. With the speeding of economic development, human capital has been of more and more preponderance in enterprise contract. Meanwhile, it has been evaluated into multi-factored property right arrangement and company management structure in its competition and cooperation process with non-human capital. It is an urgent affair to research different property rights institution and put it into practice for enterprise management and development, and at the same time it is our researchers’ responsibility.
