Abstract


Good environmental condition is the basis for human survival and development. Although China’s economy power is improving in recent years, China’s ecological environment is worsening, the conflict of human and nature have become increasingly obviouse. Party Central Committee with Hu Jintao as the core leadership attaches great importance to environmental issues, the report of the Seventeenth Party Congress has been clearly put forward the task of building an ecological civilization. As one of the main way of dealing with the conflict of man and nature, the construction of environmental legal system has important a very important significance.At present, there are lots of problems in the construction of China’s environmental legal system, such as the imperfectance of envionmental law, the absence of the basic system of environmental law and so on. But these problems are only appearances, the root causes of the problem is the lack of environmental legal system Marxist ecological thought as a guide. Has been more attention to China’s environmental legal system enacted slip laws, but not from the environmental legal philosophy and the basic system to solve the fundamental problem. The result is that the false anthropocentrism misleads the construction of environmental legal system, and the absence of the basic system of environmental law in practice faced insurmountable difficulties, the increased number of environmental laws does not make environmental legal system scientific and rational,. The root causes of this situation is the legal thingking, it is faced with the current environmental pressures in China, we advocated harmony of human and nature, sustainable development, ecological civilization of Marxist thought, ecological civilization construction tasks that the Seventeenth Party Congress proposed, and it is far from the comprehensive, coordinated and sustainable development in the twelfth Five Year Plan.Environmental legal system in China should start from the fundamental issue, under the guidance of Marxist ecological civilization thought. The way of dealing with Environmental legal system is not simply added the environmental slip law, but through the proper guidelines to make the environment legal system more complete, better adapted to our social development. To achieve this goal, we first need the correct interpretation of Marxist ecological thought, take the nature of the analysis, the harmony of human and nature and sustainable development into the environmental legal system; and then under the guidance make the construction of environmental laws, from citizens environmental rights in constitution, the environment slip laws to local environmental regulations; confirming and complete the basic environmental legal systems , such as environmental public participation system, environmental impact assessment system and ecological compensation system and so on, with the principle of dialectical thought choose Marxist ecological civilization thought, with the developing idea build China’s environmental legal system, so that the construction of China’s environmental legal system can be effective for the harmony of human and nature, sustainable development, and ecological civilization construction.
