Abstract


Corruption is the history of the earlier crimes, Although Chinese criminal law scholars study unceasingly thorough, But some problems of bribery in theory and still having dispute. In reference to the relevant data and links on the basis of the judicial practice, the author of the bribery and corruption corruption "seek interests for others", bribery and corruption, fulfills the doctrine of joint crime problems such as the content of disputes are analyzed and studied, And put forward its own views and Suggestions. Text is divided into four parts:The first part of the bribery and corruption. This section is analyzed on three kinds of bribery, and suggested that our legislation determine not legitimate interests.The second part, from the Angle of the theory of corruption "seek interests for others". In China about "seek interests for others" of the relevant laws and regulations, and then analyze the problems existing in the practice of the list.The third part, the bribery crime accomplishment standards. The author mainly from crime accomplishment and criminal attempted perspective.it is discussed. On the analysis of the criminal law and judicial explanation about the form and put forward its own standards for crime accomplishment. The fourth part, bribery crime several major forms of existence, Such as state personnel, personnel and state between staff together several forms, such as bribery. In these forms of existence, the author lists different dispute that way for bribery crime, and leads to explain the main issues exist. Finally the author from the theory of criminal law, the law regulation angles in-depth analysis of common crime bribes, hope to judicial practice.
