Abstract


In recent years, with the series of the Central Rural convening of the meeting , official and private media vigorously promote the rural collective land contract management rights transfer to solve the three rural issues . September 30, 2008 , General Secretary Hu Jintao raised in the inspection of a small village to give farmers more fully protect the land contract and management rights \. \Therefore, the author based on China's current rural land system reform hot issues to elaborate. The subject will to make comprehensive use of disciplinary knowledge of the basic theory of civil law , property law , administrative law , take the history and current situation , drawbacks and contradictions comparative research methods , on land the main system of rural collective land circulation , rural collective land circulation and from the point of view on rural collective land transfer mode initial exposition , the basic framework for the construction of rural collective land circulation theory , put forward some proposals to further improve and develop the theory of rural collective land , especially in the land the main reconstruction , the process of transfer of land price factors and to fill the current theoretical blind spots on rural collective land contract management rights transfer and the immature legal measures , with some theoretical and realistic . Throughout the article , the basic theory of general civil code based on integrated use of the theory of multi-disciplinary , interdisciplinary, integrated part of the contents , to promote the awareness of the problems in the rural collective land transfer process , and how to solve these problems has positive significance , hoping to play a role in promoting the improvement and development of the legal system of collective land circulation .
