Abstract

As the laws in early Western Han Dynasty, Jin Guan Ling which was unearthed from the Zhangjiashan 247th grave has reappeared the management system of JinGuan of the day. JinGuan is the important military defense facilities, and has the function of maintaining social stability. As a national portal, JinGuan plays an important role in the defense、political、economic and social aspects. For national security and social stability, countries establish management agency, organizing management personnel and stationed guards in important transportation rush, this is JinGuan. In peacetime, through strictly checking personnel and related materials so as to ensure national legal system of exit and entry administration effective implementation, JinGuan mainly embodies the function of maintaining social stability.In the special period in war, mainly embodies its military function; as the important military stronghold, JinGuan plays a vital role in the national defence. Especially in early Western Han Dynasty when national regime is not consolidated the social function and the military function of JinGuan is more outstanding. In this paper based on the historical study and using the methods of combing archaeological data and the literature handed, the author has systems researched legislative background and main contents and legislative idea of JinGuan.‘The early Western Han’refers to about 70 years time that from LiuBang who established the han dynasty to the early time of Wudi.This article includes preface、text and epilogue. In the part of preface the author briefly introduce the connotation of JinGuan and the meaning of the topic and the present situation of the research. In the part of epilogue the author summ up the content of this article. The part of the text is the main body part is this text, it is divided into three parts.Part1: The Legislation of the administration of JinGuan in early Western Han Dynasty. Based on studying the origin of JinGuan ,this part discusses the time when formulate JinGuan、its legislative background、its legislation form、its subject of applying legislation and its program of legislation and so on.Part2: The main contents of the Legislation of the administration of JinGuan. This part mainly study laws and regulations about entry and exit in JinGuanLing. The author overall study the main contents of the legislation of administration of exit and entry. Part3: The legislative idea of administration of JinGuan. The legislation based on legislative idea. JinGuanLing embody imperial first and legalization、strictly control the society and the officials and strengthen centralized power.
