Abstract


One of the basic responsibilities of the law is to confirm the rights and to protectthem when they are at risks or in damage. The right of legal relief has an importantpart in the system of rights and it has independence, basic, affordable and remedialstatus. However, even though there is no lack of using the concept of legal relief andthe proposition of the right of legal relief, but there is no clear awareness about themeaning of the right to legal relief in people’s mind. It is not only hinders theindependent development of the right to legal relief, but also not good for theprotection and practice of civil rights.The paper was written on the basis of Collecting, reading, collating andanalyzing of a large number of research achievements that relate to the right to legalrelief.Standing on the legal theory research platform, using the holistic and systemicperspective, the paper takes up the work of thinking about the full construction ofrights. Through semantic analysis, comparative analysis and logic analysis and othermethods, the paper defines the basic connotation of the right of legal relief, expoundsthe attributes and characteristics of the right of legal relief, analyses the value andstatus of the right of legal relief, introduces the forms of expression of the right oflegal relief and discusses the implementation of the right of legal relief.The paperpresents a holistic and systemic system of the right of legal relief to the readers, hopeto cause people to pay attention to the right of legal relief and contribute to to thetheory development and practice of the right of legal relief.
