Abstract


This paper, which writes from the perspective of jurisprudence, researches thenetwork legal supervision on civil servants with the help of the meaning, elements,legal acts, legal liability, legislation, law and democracy, law and morality, power andrights and other legal knowledge of legal supervision. It will make a legal position ofthe network legal supervision on civil servants through the explanation of basictheory, and sum up the concept of the network legal supervision on civil servants,and its subject, object, content, rights and powers and the basis which forms its fiveelements.Secondly, this paper combing with the positive effect and negative effect,whichis shaped in the process of the practice of the network legal supervision on civilservants, classify these problems from the angle of public law and private law, studythe chain effects of network legal supervision which effect legislative, judicial andother.Finally, basing on the theoretical description and summary of problemsencountered in practice and combing with the domestic and international situation ofnetwork legal supervision on civil servants,it solves the chaos of the network legalsupervision on civil servants which analyses from the three aspects of legislation,legal control of the network technology and legal control mechanism of network legalsupervision. The three aspects consist of perfecting the legal mechanism about thenetwork legal supervision on civil servants, constructing a network legal controlsystem of the legal supervision on civil servants, and establishing legal controlauthority corresponding with the network legal supervision on civil servants forpractical operation and management.It will play the biggest role in the network legal supervision on civil servantsfrom two aspects of theory and practice of the maximum. In addition,right is not free,it restrictions on the right of monitoring servants in the process of a repeated cycleamong the practice to finding problems, solving the problem and the improvement oflegislation, so that there is a certain feasible order on the open,virtual,uncertainInternet platform and realizing the interface among the network legal supervision,judicial supervision and supervision of power.
