Abstract

This article has presented the theory of The Afterwards Act Of Punished, and defines the concept of The Afterwards Act Of Punished,means after finished a perpetrating act (a previous illegal act)until the final criminal liability allocated, the offender have the thought of concealing the fact,maintaining illegal states,ensuring achieved the goal of the previous illegal act or taking advantage of the state and result to committing a new crime,meanwhile,the offender implements the new crime that violate a new legal interest. The Afterwards Act Of Punished should have independence,after feature and intentionally subjectiveness,can be classifies according to different criteria.Because of equipped with independent crime constitution conditions,and violate a new legal interest,The Afterwards Act Of Punished should be established the combined punishment crime in general,and in the special case would established one crime.The Afterwards Act Of Punished can form the corresponding relation with the The Afterwards Act Of Impunity that had existed in the criminal law theory,perfection the criminal law theory and guiding the judicial practice,then solving the problem that how to deal with the offender implement a new crime after finished a previous illegal act.
