Abstract


As the initial stage of the investigation of criminal proceedings, public injustice investigation process directly affect the entire outcome of the trial is fair, therefore, the status of the investigation and supervision throughout the proceedings is important.Prosecutors as the main investigation and supervision, not only those who bear responsibility for combating crimes, but with the important mission of protecting human rights. Investigative oversight role is mainly to prevent the wanton abuse of investigative powers to be, because the investigation is the law gives the right to a particular country authorities may be some kind of privilege to interfere with the rights of certain social subjects of hazards, if used improperly, can easily affect the Some right kind of citizens. Therefore, investigation and supervision must be timely, effective supervision, in order to prevent the occurrence of some unscrupulous investigative behavior.However, the current situation of China’s view, the supervision of the investigation and the prosecution is not in place, resulting in miscarriages of justice in the investigation stage of the frequent, often scandal investigation organs, such as hide and seek death, bathing dead, dead water, etc. the occurrence of these events clearly show that the absence of investigation and supervision, resulting in a vain caused the death of many innocent people arrested. Therefore, China is now an urgent need to improve the investigation and supervision system, to protect the legitimate rights of citizens in the investigation area. I believe that in order to solve the problems in practice investigation and supervision, it is necessary to understand the crux of the investigation and supervision, the right medicine, in order to cure the patient.In this paper, starting from four parts:The first part of the investigation and supervision system to analyze theoretically elaborated, such as the concept of investigation and supervision aspects, features, and value; second part briefly introduce foreign investigation and supervision system, and through China and contrast foreign, to analyze the existence of the investigation and supervision system in which lack of merit of what foreign investigative oversight system has; describes our current reality of the existence of the investigation and supervision system of the third part, what are the problems in practical application and analysis of these issues the main reason; fourth part is how to improve the system of supervision and investigation, proposed to build some personal thoughts.
