Abstract

From the establishment of the new china on, with the development of the market economy, Chinese land market is developing gradually. The capital feature of the land is showed up. The government of all levels have the independence of land-using. But because of the deficiency of the law and supervisory mechanism, the increase of land trading, many problems come out such as farmland losses, the land supply is out of control and law-breaking for the land use.In this situation, at April2004,the state council issued the notice about the problems of the reforming of the land management system below the provincial level which poses the vertical management system for the land below the provincial level, it indicates that the patronage for the leader of the land management department and the land use approval right below the provincial level is transferred from the local party committee to the higher level of land management department.The aim of carrying out the vertical management system for the land is to strength the control of the land. Separating the land management department from the local government is to increase the independence of the land management department in order to avoid the flowing away of the land resource, make sure the execution of the land-protection system and finally to guarantee the food security and the consistent development of the economy.The vertical management system for the land has certain advantages:1. strength the control of the land resource.2. control the abuse of the land from the local government and its intervention to the market.3. strength the independence of the lane management department and clear the relation between the land management department and the government. Make clear the responsibility.Although the vertical management system for the land has been carried out for five years, there are still many law-breaking case happening for the local government which has caused the flowing away of the land resource. Under this situation, it has great meaning to find the problems in the execution of the system and the deep reasons of these problems, make clear the arrangement of the human resource, money and substance, which will help to complete the system and the reasonable use of the land resource.This paper uses delegate-agency theory and basic theory of public administration theory, using literature study, comparative research and empirical research methods of jiangsu yizheng city land vertical management system analysis for example, points out that China’s county land vertical management system existing in the operation of the following problems:first, the vertical administration trigger straight department and local government; the contradiction between Second, land management has not really achieve vertical efficacy, illegal land phenomenon seriously, Third, the land administration department and other departments to communication reduced, reduces the administrative efficiency, weakened the integrity of the local government function, Fourth, law enforcement difficulty, system and the imperfection of administrative subject function permissions not clear lead to local government illegal land behavior is difficult to solve. On this basis, the authors developed countries for reference and regional land management system of experience, and puts forward improving our land vertical management system of some countermeasures:first, strengthening the legal system construction, strict land law enforcement, Secondly, a clear local governments and the responsibility and authority of the the land administration department, Third, the reasonable configuration, finance, property right, Again, the reform of land income distribution and usage management mechanism, Finally, establishing and perfecting supervision mechanism, including government internal supervision and external supervision.
