Abstract

In the late 1990s, especially in the new century, with China’s reform and opening up, economic development and the socialism modernization, city changes development to become inevitable process. Because the city changes a course accelerate, most of the rural collective land is levied for the state-owned construction land use, lots of farmers have lost their land, resulting in lost territory farmer cannot get safeguard, life of lost territory farmer in trouble, because the farmer land disputes complaints without the door, violent resistance to the events and other problems become more and more in relation to the state and social stability of the important problem. Landless peasants’ rights and interests protection and land requisition system reform has gradually become a focus in academic circles.In the process of land acquisition is not just the farmers lost the land, but the cost of livelihood for generations of agricultural production and lifestyle. Most farmers worried about losing a career as a farmer’s production of this way of life and low cost, low-stress living conditions. Land acquisition process is also directly related to a series of farmers’ rights, such as the right to know, get right to compensation, lost ground to protect the right to security of employment rights. These problems arise because of China’s current land acquisition system needs reform, the introduction of the Land Acquisition Act needed, the social security system needs improvement, land acquisition and oversight mechanisms need to improve, the need to improve the quality of the rural population, the concept of local economic development needs of innovation and so on.Adjacent to Beijing and Tianjin, Hebei province, as is the "motherland’s chest" , Hebei as Gyeonggi barrier, its stability and development for the country’s stability and development has an important role in promoting. In recent years, with the economic development and urbanization, the Beijing-Shanghai high-speed railway, Beijing-Shijiazhuang high iron, Shijiazhuang -Wuan high iron,Shijiazhuang -Taiyuan high iron,South-North Water Diversion Project, Caofeidian Industrial Zone, construction of a large number of key projects to promote accelerate the scale of land in Hebei Province, the stock of land and urban re-use of land is very limited, bound through the collective land to state-owned construction land to solve the land supply and demand, leading to a large number of landless farmers become landless farm employment nowhere, no copies of the three non-security people, leading to the occurrence of violence to protect their rights, is not conducive to social stability, need to take more radical measures to be a temporary solution.In research methods, this integrated use of the literature and case law analysis and other research methods, comparative analysis and case hope to explain, so the issue is more in-depth, comprehensive discussion. In the structure and content, the paper is divided into four main sections:Part I: China’s Hebei Province, land acquisition and land acquisition related systems overview. China’s land expropriation by a basic system of interpretation, analysis of what is the land, and farmers to protect the interests of the concept is. In land acquisition in what rights of landless farmers, the concept of public interest and the interests of farmers whose land the relationship. In view of the above problems and reason analysis, this part puts forward six countermeasures: establishing special regulations of land expropriation; to reform the existing taxation system and standardize government behavior that ask for the ground; perfect social security system of landless peasants and collective land property right system; rich land expropriation compensation method; improve the land acquisition relief mechanism and supervision mechanism in the process of land expropriation on the public interests; clearly defined. Hope that through these countermeasures to Hebei province peasant interests in land expropriation guarantee problem solving help.In summary, Hebei Province, to protect the interests of farmers in land acquisition problems produce the deeper reasons for living in the Bohai Economic Zone and the capital of Hebei Province barrier is to maintain social stability and economic development is both a major event. Improve the land acquisition system, establish and perfect the social security system of landless peasants, to effectively protect the interests of farmers whose land is to build a harmonious society. This paper seeks to Hebei Province, the land acquisition process by protection of the rights of migrant status to further improve the practical measures proposed.
