Abstract


In2001through decades of unremitting efforts, China has finally become a member of WTO, the foreign trade of China entered a new period. Thanks to free trade rulesd,the WTO provides China of adequate foreign trade opportunities,it also adds unlimited power to the economic growth of china. Total amount of foreign trade of our country continues to increase.In the past foreign cooperation was just within single economic area, now it has extended tomany all-round cooperation at multiple levels. But the trade and the friction exist at the same time, and constantly increase. After the financial crisis, in order to stimulate the economic development and shake off the impact of the crisis, many countries addtied to using trade remedy measures, trade protectionism is back. China has become the hardest hit areas of anti-dumping. The United States is China’s largest trading partner, the EU is second, but at the same time, the United States and the European Union take China as the main target country of anti-dumping, anti-dumping cases increase every year. A large number of anti-dumping investigations have brought Chinese export enterprises both economic benefit,and serious impact on the economic development and social stability in china. In the post crisis era, the European Union, the United States is trying to use anti-dumping measures to stop the export of Chinese products, to create more space for the development of domestic enterprises, resulting in the abuse of anti-dumping measures.The anti-dumping investigations have been launched for Chinese PV products, It is the first time we get investigation in the new field of energy. The amount of money involved is the biggest, with the worst influence. Therefore, there are urgent need for the relevant research.The paper is based on reading a lot of Chinese and foreign literature. Firstly I tease the concept of dumping and anti-dumping, anti-dumping measures, anti dumping law and the anti-dumping mechanism.Secondly after analyzing the anti-dumping cases launched by the EU and the United States, I summarized the characteristic, then specific to the anti-dumping case that the EU and the United States launched to China PV products,I find out its characteristic and its influence factors.Based on a large amount of data collected, I summarized the effect of the case in international and domestic. Photovoltaic dispute is not complete, if we want to actually reverse the situation to win the living space and the policies fair and reasonable for the enterprises, we should pay more effort. This paper combines the actual conditions of the photovoltaic industry in Shandong Province, to explore ways to improve the ability of responsing to anti-dumping. This paper analyzes measures from three aspect:enterprises, government, industry associations,enterprises. Enterprises should do that:enterprise unite, fight actively; enhance the technological content of products, establish brand awareness; based on the range of the existing market, and actively develop the overseas market. The government should do that:use diplomatic advantage, strengthen the foreign trade negotiation efforts; moderate supportdomestic solar energy project to build, help enterprise temporarily finish the transition; to guide the adjustment of industrial structure, promote the diversification of the export industry. Industry associations shall do that:to fully play the role of anti-dumping organizer; industry associations should do a good job of internal and external coordination work; to establish and perfect the relevant industry database, enhance the awareness of early warning. I hope that this paper can provide the beneficial help to the future with photovoltaic anti-dumping cases and provide the support for the formulation of trade policy.
