Abstract


In practice, the liquidated damages of labor contract dispute frequently, Employers usually restrict the mobility of workers by setting excessive liquidated damages of labor. The freedom of workers choosing the right is undermined greatly, rational and orderly labor flow is limited, that is not conducive to the economic development and the harmony and stability of society, there is the great practical significance of researching the labor contract system for liquidated damages in this article. To the violation of labor contract compare with the Violation of civil contract in this article, Through the system of labor contract the concept of liquidated damages, researched the nature, functions, features and other basic theoretical issues through the labor contract system of our cancellation, it has analyzed the defect of labor contract system of liquidated damages under the framework of China’s current labor laws, put forward some feasible proposals in the same time. This is able to make a substantive contribution for Judicial Work Practice of Our labour relations.
