Abstract


Labor dispatch system originated from the United States in 1950s and grew in Europe and Japan. In China, the labor dispatch first appeared in the economically developed regions such as Guangzhou, Shenzhen, Beijing, Shanghai and other places, and then developed in most parts of the country. The emergence of labor dispatch has caused widespread controversy, the positive evaluation is that it can promote employment, rich the employment situation, save the labor cost and enhance the vitality of enterprises. On the other hand, Negative assessment is that it can damage the interests of labors, make the enterprises avoid employer responsibility and increase social instability.This paper begins with the concept of the labor dispatch, bases on the relevant laws and regulations of typical countries and regions, then sums up the current legislation of labor dispatch and put forward the suggestions for improving the system of labor dispatching, in order to protect the labor rights, making it develop healthily and harmoniously.This paper is centered on the perfect of the labor dispatching system and is divided into four parts.The first part is an overview of labor dispatch system. This part aims to get an overall view of the labor dispatch through the basic introduction.The second part is to introduce the regulations and relevant provisions on labor dispatch of typical countries and regions and the inspirations on legislations of china. First, it introduces the legislations on labor dispatch in the United States, Germany, Japan and Taiwan. Then show the aspects which we should learn from, This part aims to perfect our labor dispatch system through learning from other countries and regions’experience.The third part is the legislative situation of labor dispatch and existing problems. Clearly pointing out the defects is to solve the problem effectively.The fourth part is the perfect of labor dispatch System. This part is mainly talks about the suggestions of perfect the legislation of labor dispatch system.This section intends to provide useful suggestions for labor dispatch perfect.
