Abstract


News infringement litigation occurred frequently in recent years, thus the lack of protection by associated legislations which could not guarantee the freedom of news report generates negative effects, and controversy between legal protection for freedom of news report and personality rights is still existing among theorists. Therefore, building and enhancing the news infringement legal system protection is the urgent priority.First of all, this article intends to describe news infringement and defence privilege of news torts ;and tries to analyze the balance between the freedom of news report and personality rights to present the theoretical basis and foundation of vale, which is in order to illustrate the function of defence privilege of news torts to guiding, evaluating, and value declaring, and accurately improve the legal basis and necessity of .Secondly, author provides reference and comparable proof after sorting and summarizing the content of Common Law and Civil Law about legal protection for news defamation and news invasion of privacy.Thirdly, this article will clarify and summarize the lawmaking, judicature and theoretical research of Chinese defence privilege of news torts. Last but not least, author comes up with own thinking and suggestion about how to perfect Chinese defence privilege system of news torts. It should be make sense through building the judicial interpretation for the main source of law, take example by the related foreign legal theories and speed up the research of the internet defence privilege of news torts to build and perfect the law system of defence privilege of news torts.
