Abstract


The unique name of a well-known commodity in China 's \This affects the character of legal justice , and the main players in the market can not be effective guidelines and determine their own behavior is expected . Introduced from three case of well-known peculiar definition of the name and its judicial determination standards , and put forward suggestions for improvement of the existing legal system . Text in addition to the introduction and conclusion , is divided into four parts . The first chapter analyzes from three typical cases , pointed out that according to the Anti- Unfair Competition Law \important practical significance . The second chapter , from the point of view of the legislative and judicial practice , the analysis of the drawbacks of the visibility of the well-known peculiar name and unique identification standards exist in the current judicial practice considerations scales vary difficult to effectively guide the practice of law . Chapter III , on the particularity of the relevant legal system based on international conventions and foreign , comparative analysis of the legislation and practice of the well-known peculiar name identified in the scope of application of the well-known peculiar name , identified confuse the misidentification range find out relevant experience for reference . Chapter 4 proposed to improve our system finds the unique name of a well-known commodity , must improve the relevant legislation , the conditions and criteria are clearly identifiable , and constantly improve the identified program recommendations ; enterprises should further strengthen the awareness of self-protection , to prevent the desalination name suggestions.
